Buying a home is a major life experience, and the largest financial investment most people will make. Involving a skilled and experienced real estate lawyer early in the process helps ensure smooth and properly handled transactions, avoiding future litigation over ownership, liens, easements, and more. At the law firm of McBride Richardson, P.C., we have practiced real estate law in Decatur, Alabama, since 1981. We know the law, we know the real estate, and we know the people. A few of the duties and responsibilities of the closing attorney are:

  • Title examination to determine whether the seller is the legal owner of the property; to uncover unpaid mortgages, judgments, or liens that must be satisfied; to identify restrictions, easements, or other encumbrances; and to determine the status of property taxes;
  • When provided, examination of the survey in order to assure no encroachments on the property;
  • Preparation and examination of all documents necessary to complete the transaction, including the deed, closing statement, promissory note, mortgage and other security instruments, and all documentation required by the lender in order to effectuate your closing;
  • Conducting the closing on behalf of the lender, and making sure that buyer, seller, and lender are protected;
  • Filing the necessary documents in probate court, correcting inadvertent errors arising at closing, and issuing the title insurance policies;
  • Conducting all post-closing follow-up required by the lender.
